Re: Cease and Desist Cybersquatting of the name UNIMUNDO, U.S. Trademark Registration 4,077,714
To Fabulous, PTY LTD, Reinvent, Hitfarm and Domain Brokers, et al:
I am the President and CEO of Unimundo Corporation d/b/a UNIMUNDO and UNIMUNDO.COM. The Board of Directors of Unimundo Corporation has asked that I continue to communicate with all of you regarding your defiant, protracted, unlawful “Cybersquatting” and your continued advertising for sale of the name www.unimundo.com.
In the last several years we have have repeatedly admonish you and have placed you on notice that we own the trademark names for both UNIMUNDO and UNIMUNDO.COM. Since, in or about March 2010, we have made numerous written demands for you to Cease and Desist Cybersquatting the name UNIMUNDO to no avail; you continue to think that all of you are above the law.
Despite our repeated demands you are persisting in attempting to sell the name www.unimundo.com to any unsuspecting highest bidder or buyer knowing full well that any sale, transfer and/or conveyance of the Domanin Name www.unimundo.com to anyone other than to Unimundo Corporation will not only be a sham and a fraud; such transfer will be void on its face.
Cybersquatting or Domain Squatting is against the law under the U.S. Anti-cybersquatting Consumer Protection Act, by registering, trafficking in, or using a domain name with bad faith intent to profit from the goodwill of a trademark belonging to someone else. See Title 15 U.S.C. § 1125 and U.S.C. § 1129. So far the evidence will clearly demonstrate that you have been Cybersquatting the name Unimundo for more than two (2) years while we have placed repeated demands for you to release the name to Unimundo Corporation. What you are doing is a gross violation of United States and International law.
You are, once again admonished that you to contact us to make arrangements for an orderly transfer of the domain name www.unimundo.com to Unimundo Corporation.
We have every intention to pursue legal action against you in the United States District Court should you continue to refuse to transfer the name to us. We will also institute legal action against anyone possessing, owning and/or attempting to buy the name UNIMUNDO from you or from anyone else.
This letter is once again written and served upon you through www.unimundotv.com, via the Internet, by mail to the above address and through your website www.domainbrokers.com , www.reinvent.com and www.hitfarm.com with full reservation of all legal rights and remedies available to Unimundo Corporation.
