1.  These are the Uploading Terms of UNIMUNDO

THIS IS AN UPLOADING CONTRACT AND THE CONTRACT IS LEGALLY BINDING.

DO NOT UPLOAD, SUBMIT, USE OR ENTER THE UNIMUNDO WEB-TV WITHOUT READING THIS LEGAL DOCUMENT. THIS DOCUMENT IS A LEGAL CONTRACT BETWEEN “YOU” AND UNIMUNDO CORPORATION (“UNIMUNDO”). HERE ARE YOUR RIGHTS, PRIVILEGES AND OBLIGATIONS UNDER THIS CONTRACT.

THIS DOCUMENT MAY ALSO BE AVAILABLE IN OTHER LANGUAGES FOR ILLUSTRATION PURPOSES ONLY.  IF AT ANY TIME THERE IS A DISCREPANCY BETWEEN THE PAGES WRITTEN OR TRANSLATED IN OTHER LANGUAGES TO THIS ONE IN ENGLISH, REGARDING THE “VIDEO UPLOADING AND SUBMISSION TERMS OF UNIMUNDO” AS IT IS FULLY SET FORTH HERE, THIS VERSION IN ENGLISH SHALL AT ALL TIMES CONTROL FOR PERSONAL AND LEGAL PURPOSES AND/OR FOR ANY OTHER PURPOSE.

YOU ARE SOLELY RESPONSIBLE FOR RESEARCHING, INVESTIGATING AND UNDERSTANDING YOUR LEGAL RIGHTS AND OBLIGATIONS UNDER THE TERMS OF THIS CONTRACT.

USING THIS WESITE IS A PRIVILEGE NOT A RIGHT AND ITS USE IS ON A VOLUNTARY BASIS. 

BEFORE SUBMITTING, TRANSMITTING LIVE, USING AND/OR UPLOADING ANY VIDEO OR VIDEOS OF ANY KIND FOR THE FIRST TIME, AND EVERY TIME THEREAFTER YOU MUST READ AND AGREE TO THE TERMS OF THIS UPLOADING AND SUBMISSION CONTRACT, WHICH APPLIES TO YOU AND TO ALL LIVE STREAMS AND/OR VIDEOS UPLOADED FROM OR TO YOUR ACCOUNT BY YOU, FROM YOU OR BY YOU USING ANYONE ELSE’S ACCOUNT FROM ANYWHERE OR FROM ANY LOCATION AT YOUR DIRECTION, CONTROL AND/OR ON YOUR BEHALF, AT ALL TIMES RELEVANT HEREIN.

2.  Who May Use or Upload Videos and/or Media to the UNIMUNDO WebTV

a.  You must be at least 13 years old to use and/or Upload Videos to the UNIMUNDO WebTV.

b.  If you are at least 13, but are still a minor (this depends on where you live), you must have your parent or legal guardian's permission to use the UNIMUNDO WebTV, have him or her read this Agreement with you.

3.  Notice to Parents and Guardians

a.  By granting your child permission to use UNIMUNDO WebTV, you agree to the terms of this Agreement on behalf of your child. You are responsible for monitoring and supervising your child's use of the UNIMUNDO WebTV.

b.  If your child is using the UNIMUNDO WebTV and is either under 13-years of age or does not have your permission, you are fully responsible for contacting us immediately so that we can disable his or her access.

c.  If you have questions about whether the UNIMUNDO WebTV is appropriate for your child, review our Frequently Asked Questions (FAQ) and our Safety and Privacy suggestions or contact our legal department This email address is being protected from spambots. 4.  Warning

a.  Even if you are old enough, meaning you are at least 18-years old or older to use the UNIMUNDO WebTV and/or you have your parent's or guardian's permission, some of the content available within the UNIMUNDO WebTV may not be appropriate for you.

b.  UNIMUNDO has content that may contain "R-rated" material, nudity, profanity, and mature subject matter. If you are under 18, do not view such content.

5.  Terms and Conditions for Video Uploading and/or Submission.

a.  You may upload the following file formats:  jpeg, jpg, mov, mpeg, png, divx, pdf, flv, wma, mp3, gif, mpg, avi, mp4, aac.

b.  Media files uploads shall not exceed Five Hundred Megabits (500 MB).

c.  Title of files including spaces shall not exceed Sixty (60) Characters.

d.  Description of files including spaces shall not exceed One Thousand (1,000) Characters.

e.  Tags separated by comas shall not exceed 15 (15) words.

6.  Content Restrictions.

a.  You may not upload, post, or transmit, submit, any video, image, text, audio recording, or other work content  which:

b.  infringes any third party's copyrights or other rights e.g., trademark, privacy rights, etc.;

c.  Contains sexually explicit content or pornography provided, however, that non-sexual nudity is permitted;

d.  Contains hateful, defamatory, or discriminatory content or incites hatred against any individual or group;

e.  Exploits minors;

f.   Depicts unlawful acts or extreme violence;

g.  Depicts animal cruelty or extreme violence towards animals;

h.  Promotes fraudulent schemes, multi-level marketing (MLM), get rich quick schemes, online gaming and gambling, cash gifting, work from home businesses, or any other dubious money-making ventures;

I.  Violates any law;

j.  All videos you submit must also comply with our Terms of Use, which are incorporated by reference into this Agreement.

7.  You must own the Video or Media

a.  Do not submit or upload any video, videos or media that you do not own or that you do not have the permission to use or upload.

8.  Do not infringe on the copyrights of others.

a.  If you submit any video or videos depending on the content value, UNIMUNDO reserves the unilateral and exclusive right to delete or take down your video, vdeos and/or media without notifying you. Likewise if you see any type of Media whatsoever that you establish it should not be part of UNIMUNDO or that infringes the Copyrights of others, you must report such Media to UNIMUNDO.

9.  Your Video or Media must be of artistic value, good quality, High Definition “HD” or High Quality “HQ.”

a.  UNIMUNDO wants to protect the quality and artistic integrity of all the other High Quality videos belonging to our other members. If your video or media is not of good commercial quality or HD or HQ; UNIMUNDO reserves the unilateral and exclusive right to delete or take down the video, videos or media without notifying you.

10.  Your Video or Media must be within legal limits

a.  If your video contains or even implies any sort pornographic content, illegal acts or any other type illegality whatsoever, in violation of any law and/or the UNIMUNDO Terms of Use contract, we will delete it and/or take it down.

b.  Nudity does not mean and is is not the same as "pornography" just as long as the nudity is of artistic value and it is tastefully done.

b.  UNIMUNDO also reserve the right to report any violations of law to the appropriate Law Enforcement Agency.

11.  You must be a natural person

a.  By submitting a video, videos or media to UNIMUNDO you hereby agree to be bound by, and unconditionally understand that you are a natural person and that all videos uploaded by you or on your behalf by anyone else, such as any third party, fully comply with the laws of the United States as explained in the Terms of Use.

12.  Posting and sharing of Videos or Media of personal nature

a.  You understand that the videos or media are intended, althought not limited to post and share videos of a personal nature that is:

(i)     of you or your friends,

(ii)    is taken by you or your friends, or

(iii)   is original art and/or animation created by you or your friends.

b.  Therefore, you agree to not upload any videos or media other than good quality videos, HD or HQ original works created by you or your friends and you have been authorized to upload or to use the video or media.

13.  Do not upload any material that you are not authorized to upload

a.  You agree that you should not upload or use any type of property that is not yours or the property of another or any videos or media that infringes upon or violate the legal or personal rights, copyright, trademark, publicity, privacy or any other rights of any third party and that you will not to attempt to circumvent any content filtering techniques that UNIMUNDO may employ to detect such infringement.

14.  You must have the legal right

a.  In order to upload to UNIMUNDO you must own or hold all necessary rights and copyrights to the videos or media and you must follow the rules set forth in our Terms of Use and Privacy Guidelines. If you do not follow these simple rules, UNIMUNDO reserves the right to delete your uploaded content and/or cancel your UNIMUNDO account without any notice or warning to you.

15.  These guidelines

a.  We provide this guidelines for your convenience and information, and they should be read together with the Terms of Use which govern your use of the our website and the services we provides to the public.

16.  Upload Only Videos You Create and/or Have the Necessary Permission Upload.

a.  You may only upload videos you own or have created yourself or participated closely in the creation and/or production of the video.

b.  You must own or hold all necessary rights, and/or copyrights to the video or videos.

c.  Directors, DPs, editors, musicians, graphic effects artists, and actors may all upload work in which they have contributed significantly and have permission to upload.

d.  "I have permission" is not the same as you created it or that you own it.

e.  Public domain videos from any source are strictly prohibited.

f. Users uploading popular or professional content that they have created should add their role and involvement in the video description and on their profile to avoid accidental deletion.

17. Do Not Upload Videos Intended for Commercial Use.

a.  You shall not upload commercials, infomercials and/or demos that actively sell and/or promote a product and/or service, except:  independent production companies, authors, musicians, nonprofits, churches, artists, and actors may show or promote the work they have created.

b.  It is sgtrickly prohibited to use UNIMUNDO to use UNIMUNDO as a Hosting Server in any way or form and/or to externalize hosting costs or for advertising purposes.

c.  UNIMUNDO is a business but it is not in business to provide any sort of service nor is it interested in providing any business service.

d.  You may not upload videos containing advertising, before, during and/or after the video, unless you have obtained prior written permission from UNIMUNDO. e.  Videos considered advertising and/or with any advertisements in them, including links to commercial sites, regardless of content, will be removed without notice.

f.  You may not upload videos pertaining to Multi-Level Marketing (“MLM”), get rich quick, cash gifting, work from home business, or any other dubious money making ventures or videos that may even be remotely questionable.

g. You may not upload product promotions or sales videos, such as real estate walkthroughs, virtual videos dealing with any kind of sales and/or sales of any type of vehicles without the written consent of UNIMUNDO.

h. Television stations may not dump and/or redistribute their programming through unless UNIMUNDO has entered into a bilateral agreement in writing signed by both parties.  Please contat This email address is being protected from spambots. You need JavaScript enabled to view it. .

i.  UNIMUNDO does reserve the right to allow certain commercial or advertising content for those businesses that have coordinated sponsored advertising campaigns or are in direct partnerships with UNIMUNDO.

j.  You are allowed to upload Public Service Videos and/or charitable videos as long as there is no solicitation for moneys to be sent to anyone.

k.  There shall be no solicitation of charitable donations through UNIMUNDO unless approved in writing by UNIMUNDO.

l.  The videos you upload shall have no religious content or any religious offending content.

18.  You Are Not Allowed to Upload the following

a.  Game Play videos;

b.  Fan-Vids;

c.  Sexually Explicit Videos portraying penetration or intercourse;

d.  Music Videos, Movies, Television Clips and/or Movie Trailers you found on the Internet;

19.  You are Expressly Prohibited from Uploading the Following

a.  Any type of child pornography content will immediately be reported to federal, state or local authorities, upon detection.

b.  Videos containing or depicting or that incite bulling, hatred, include hate speech, defamatory or discriminatory speech or videos depicting unlawful acts or violence, child pornography, drugs, child abuse, elderly abuse, cruelty to animals, deforestation and/or any harm to our planet or our beautiful environment will immediately be reported to federal, state or local authorities, upon detection.

c.  Videos containing, depicting or promoting yourself, unless they are videos of yourself on TV, as long as you have the permission to upload and the video is limited to your involvement in the specific program.

d.  Videos containing or depicting compilations of scenes from TV or movies.

e.  Videos containing or depicting video games or game play, regardless if it is edited or not.

f.  Machinima with a story is allowed, provided the story is more than "guys doing exactly what the game was made for (e.g. skateboarding or shooting people)".

g.  Machinima videos must be properly labeled as such in the video description to avoid accidental deletion.

h.  Videos containing or depicting videos of game developers of their work provided they cite their involvement in the description of the video (maps and mods to commercial games don't count). Here we are talking about development videos, not commercial trailers.

20.  UNIMUNDO does not pay Royalty Fees for Media Uploaded to Unimundo

a.  Unimundo does not pay money, royalty fee, remuneration, finder's fee, referral fee or any other type of money for any video, videos or media you upload or anyone else uploads on your behalf.

b.  You agree that Unimundon will not pay money in any way or form to you. That means that Unimundo will not pay you or anyone else for the video, videos or media you upload or provide by any other means to UNIMUNDO.

c. The only benefit you may receive from uploading any media to UNIMUNDO is that from placing your video, videos or media with Unimundo it may may be that your video, videos or media may be seen by more people, which may allow you to better market or sell your media or talents somewhere else. 

d. UNIMUNDO does not make any promises, representations or guarantees; implied, in writing or in any other way that you will make any money elsewhere from your media, talent or efforts.

e. We do not pay for any talent, video, videos or media unless we have an agreement to do so in writing signed by both parties.  If it is not in writting it does not exist!

f.  UNIMUNDO is in business to make money for its Shareholders through any form advertising or by marketing of your video, videos or media for the sole benefit of UNIMUNDO.

g.  You are not entitled to any profits earned by UNIMUNDO and or by any other entity of UNIMUNDO for marketing or selling you video or media to anyone.

h.  If you upload, submit or place your video, videos or media;  UNIMUNDO, will use the video, videos or media directly or indirectly to generate revenue for UNIMUNDO.

i.   Any moneys made, as explained here, by UNIMUNDO shall be for the sole benefit of UNIMUNDO.

j.  You will not be entitled to any money UNIMUNDO makes as the result of you uploading or placing your videos, videos or media to UNIMUNDO.

k.  If you are looking to make money from your video, videos, media, art, talent or you think you are entitled to receive any money, remuneration, royalty or any other type of compensation for your video, videos, meida or your efforts, such as for your time, creative genius, work product or artwork UNIMUNDO is not for you;  you must then look elsewhere.

l.  Unimundo also does not pay any money to anyone else on your behalf, such as your heirs, successors or assigns.

21.  IF YOU HAVE ANY QUESTIONS REGARDING THESE UPLOADING GUIDELINES YOU SHOULD CONSULT WITH A COMPETENT ATTORNEY. 

22.  BEFORE YOU UPLOAD YOUR VIDEO OR VIDEOS TO UNIMUNDO YOU SHOULD HAVE AN ATTORNEY EXPLAIN TO YOU YOUR RIGHTS, PRIVILEGES AND OBLIGATIONS UNDER THE TERMS OF THIS CONTRACT.  

23.  YOU SHOULD HAVE YOUR ATTORNEY EXPLAIN THIS CONTRACT TO YOU.  THIS IS A BINDING CONTRACT!

23. UNIMUNDO RESERVES THE RIGHT IN ITS OWN DISCRETION TO ALLOW CERTAIN COMMERCIAL CONTENT FOR THOSE BUSINESS OR PEOPLE THAT HAVE COORDINATED SPONSORED ADVERTIZING CAMPAIGNS OR IN DIRECT PARTNERSHIPS WITH UNIMUNDO. PROVIDED THE AGREEMENT IS IN WRITING AND SIGNED BY ALL PARTIES. IF IT IS NOT IN WRITING IT DOES NOT EXIST.

24. FAILURE TO ADHERE TO THE TERMS OF THIS CONTRACT AND THE TERMS OF USE WILL RESULT, AMONG OTHER THINGS, IN THE TERMINATION OF YOUR ACCOUNT AND THE DELETION OF THE CONTENT YOU HAVE UPLOADED OR POSTED ON UNIMUNDO WITH OR WITHOUT NOTICE AT THE SOLE DISCRETION OF UNIMUNDO.

25.  WHEREFORE, YOU HEREBY AGREE THAT:

A.  By entering or using the UNIMUNDO WebTV, I state to have read, agree and understand this Contract.

B.  I understand [my] legal rights and my obligations under the terms of this video Uploading Termsaand the Terms of Use. I am of sound mind. I am an adult, I can legally enter into any contracts and I can make decisions for me and on my own;

C.  I fully agree with all of the terms and conditions stated here and as fully explained in the Terms of Use;

D.  I further understand that I should consult a competent attorney before uploading any videos to UNIMUNDO or voluntarily using the UNIMUNDO website; and

E.  I am fully aware that my participation in Unimundo is completely voluntary and that I DO HAVE the right to not use the UNIMUNDO website.

F.  THEREFORE, I do not dispute or challenge the provisions of this Uploading Contract and agree without any reservations with the terms of this Uploading Contract and the Terms of Use of UNIMUNDO.
